venimar is a brand of Ricardo da Cruz, Unipessoal Lda., Rua Sebastião Lopes 14, 4935-233 Viana do Castelo, Portugal · RNAAT 916/2024.
1. Rental period and late return
The rental period begins when the bicycle is picked up or delivered and ends when it is returned at the agreed date, time and location.
Any late return may be charged according to the applicable rates.
If a late return causes loss of a subsequent booking, operational disruption, additional transport or other measurable loss, the renter is responsible for those additional costs.
2. Bicycle condition and documentation
Bicycles and rented equipment are provided in good working condition.
Photos and/or videos may be taken before handover and after return to document the condition of the bicycle and accessories.
3. Rental price and charges
The rental fee, any deposit or pre-authorisation, optional services, delivery or collection charges and any additional fees are stated during the booking process, in the booking confirmation or in the applicable rental record.
Prices may vary depending on the bicycle, rental duration, delivery arrangements and selected extras.
4. Security deposit
A security deposit or card pre-authorisation of €200 per bicycle may be required before the rental begins, unless otherwise agreed.
venimar may adjust this amount on a case-by-case basis.
Any pre-authorised amount will generally be released within 7 to 14 working days after return, minus applicable fees or charges.
5. Rider responsibility and use
The renter must comply with all applicable traffic laws and use the bicycle responsibly.
Helmet use is strongly recommended for all riders. Helmet use may be mandatory under applicable law in certain cases, including for minors in some jurisdictions.
The bicycle may not be used for illegal activities, reckless behaviour, racing, stunt riding or any use beyond its intended purpose.
The renter is responsible for the safekeeping of the bicycle and any rented equipment during the rental period.
6. Locks, personal items and electronic devices
Lock codes must not be changed. All combination locks must be returned with the original code. If a lock code has been changed, the lock must be replaced at the renter’s expense.
Riders are responsible for ensuring that personal items and electronic devices are securely fastened during the rental period.
venimar is not liable for the loss of or damage to personal items or electronic devices, including items attached to or stored in provided mounts, holders or bags.
7. Damage, loss and optional damage waiver
The renter is responsible for any damage, loss or theft occurring during the rental period, except where caused by normal wear and tear or by a confirmed defect not attributable to the renter.
Punctures, flat tyres or damaged tubes are not considered normal wear and tear unless caused by a confirmed manufacturing defect.
Optional damage waiver:
- Coverage up to €50: €20
- Coverage up to €100: €37.50
- Coverage up to €150: €55
If the damage waiver has been purchased, accidental damage to the bicycle is covered up to the selected amount. For damage above the selected coverage amount, the renter remains responsible for the difference.
In the event of total loss or theft of the bicycle, the renter is responsible for replacing the bicycle with an equivalent model of the same type and condition.
The damage waiver does not cover:
- theft or total loss of the bicycle
- gross negligence
- intentional damage
- criminal acts
- misuse or unlawful use
- failure to comply with these terms
- loss, theft or replacement of rented accessories or rented equipment
- lock codes changed by the renter
For loss or theft of rented accessories or equipment, including but not limited to locks, phone mounts, lights, bags, GPS devices, cameras, chargers or similar items, the renter is responsible for the replacement cost of each item, regardless of whether the damage waiver was purchased.
8. Delivery and location changes
Delivery and collection services are charged separately according to venimar’s current transport rates.
The agreed pickup or return location may only be changed with prior approval from venimar. Any additional costs resulting from a location change shall be borne by the renter.
9. Assistance, maintenance and breakdown support
Normal wear and tear caused by ordinary use is covered by venimar.
If assistance, breakdown attendance, inspection, collection, technical support or any call-out is required due to customer error, customer-caused damage, misuse, an avoidable situation, inability to continue riding or inability to resolve a basic issue, venimar may charge:
- up to 20 km of actual driving distance: €10 flat fee
- above 20 km of actual driving distance: €1.60 per km
Distance is calculated by actual driving route and not by straight-line distance, unless otherwise agreed in writing.
10. Cancellation policy
A 30% deposit applies to all reservations unless otherwise agreed in writing.
- Cancellations are free up to 48 hours before the rental start for on-site pickup and on-site return.
- Cancellations are free up to 72 hours before the rental start for rentals involving delivery and/or collection outside the premises.
- After the applicable deadline, the 30% deposit is non-refundable.
- If cancellation occurs less than 24 hours before the rental start, 50% of the total booking value is due.
11. Liability
venimar is not liable for injuries, accidents, damage or losses occurring while the bicycle is in the renter’s possession or use, except where liability cannot legally be excluded.
The renter is responsible for using the bicycle in a safe and suitable manner.
12. Governing law
These Rental Terms & Conditions are governed by the laws of Portugal.
By making a booking, the customer acknowledges and accepts these Rental Terms & Conditions.
